("MAINSTREET TRAVEL") provides website features, membership enrollment, and access to travel agent resources to you when you visit or make a purchase at www.mainstreetagencytravel.com (the "Site"). MAINSTREET TRAVEL provides these services subject to the following conditions.

Agreeing to These Terms & Conditions
IMPORTANT – PLEASE CAREFULLY READ AND UNDERSTAND THESE TERMS AND CONDITIONS OF USE & SALE (THESE “TERMS”) BEFORE PURCHASING A MEMBERSHIP.
THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES INCLUDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES.
General Use
The use of www.mainstreetagencytravel.com, owned and maintained by MainStreet Travel Agency, Inc. (“MAINSTREET TRAVEL,” “we,” “our,” “us”), is governed by these Terms. By accessing, using, or purchasing a membership over the Website, you and your business agree to the terms and conditions set forth herein.
THIS IS A BINDING AGREEMENT. THESE TERMS, TOGETHER WITH YOUR INDEPENDENT CONTRACTOR AGREEMENT (IF EXECUTED), PRIVACY STATEMENT, AND CODE OF CONDUCT, FORM A LEGALLY BINDING AGREEMENT.
SECTION 1 – Website Use & Eligibility
The Website is intended for businesses operated by adults. If you purchase a membership, you are affirming that you are at least 18 years old or the legal age of majority in your state or province. You acknowledge that purchasing a membership does not automatically guarantee status as an active agent; you must also successfully execute the Independent Contractor Agreement and pass any required background checks (if applicable).
SECTION 2 – Intellectual Property & License
All aspects of our Website and the materials provided upon membership purchase (including digital downloads, training manuals, and logos) are protected by U.S. and international copyright laws.
No Sharing: Your membership login and purchased content are for your individual business use only. Sharing your account credentials or proprietary MainStreet training materials with non-members is strictly prohibited and grounds for immediate termination without refund.
SECTION 3 – Payment Processing (Stripe)
We use Stripe, Inc. ("Stripe") as our third-party payment processor.
Agreement to Stripe Terms: By making a purchase on this Site, you agree to be bound by Stripe’s Services Agreement.
Security: While we take reasonable steps to secure the Site, MainStreet Travel Agency, Inc. does not directly store your full credit card information. Processing errors or security breaches originating from Stripe’s infrastructure are governed by Stripe’s policies.
SECTION 4 – Membership Enrollment and One-Time Payment
PLEASE READ CAREFULLY. THIS SECTION GOVERNS YOUR PAYMENT.
One-Time Fee: The membership fee displayed at checkout is a one-time, non-recurring payment.
No Recurring Charges: You will be charged only once for your initiation and access to the program. There are no automatic renewals or monthly subscription fees associated with this purchase.
Access Rights: Payment of this one-time fee grants you access to MainStreet Travel Agency's tools and training materials for the duration of your active Independent Contractor status.
SECTION 5 – Refund Policy
All Sales Final: Due to the immediate nature of the digital access, training materials, and proprietary tools provided upon purchase, ALL SALES ARE FINAL.
No Refunds: MainStreet Travel Agency, Inc. does not offer refunds for "change of mind," lack of business activity, or failure to complete the onboarding process. Once the fee is paid and access credentials or materials have been generated/sent, the service is considered rendered.
SECTION 6 – Relationship of Parties
Purchasing a membership on this Site facilitates your entry into a business relationship with us, but it does not create an employment relationship. You are an Independent Contractor. The terms of your commissions, tax responsibilities, and operational duties are governed by the separate Independent Contractor Agreement you sign. In the event of a conflict between this website’s Terms and your Independent Contractor Agreement regarding commissions or employment status, the Independent Contractor Agreement controls.
SECTION 7 – Commission Information Disclaimer
While this Site may market potential commission tiers or earning examples:
No Income Guarantees: MainStreet Travel Agency, Inc. does not guarantee that you will earn any specific amount of income. Travel industry earnings are dependent on market conditions and individual agent effort.
Actual Payments: Commission payouts are calculated based on completed travel and actual funds received from suppliers, strictly in accordance with your Independent Contractor Agreement.
SECTION 8 – Termination and Forfeiture
We may terminate your membership and access to this Site at any time if you violate these Terms or your Independent Contractor Agreement.
Effect of Termination: Upon termination, your license to use our booking tools, credentials, and training materials is immediately revoked.
No Refund on Termination: If your account is terminated for violation of these Terms or the Independent Contractor Agreement, the one-time membership fee is forfeited and will not be refunded.
Forfeiture of Commissions: If your account is terminated for cause (as defined in your Independent Contractor Agreement), any pending or future commissions may be subject to forfeiture as outlined in the clause dated November 22, 2024 (or as amended in your specific agreement).
SECTION 9 – Limitation of Liability
IN NO EVENT SHALL MAINSTREET TRAVEL AGENCY, INC. BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS). OUR LIABILITY FOR ANY CLAIM ARISING FROM YOUR PURCHASE ON THIS SITE SHALL NOT EXCEED THE AMOUNT OF THE ONE-TIME FEE YOU ACTUALLY PAID TO US.
SECTION 10 – Dispute Resolution (Arbitration)
ANY CLAIM MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. You agree that any dispute arising out of your purchase or membership shall be resolved by binding arbitration in Washington County, Utah. You waive your right to a jury trial and your right to participate in a class-action lawsuit.
SECTION 11 – Indemnification
You agree to indemnify and hold harmless MainStreet Travel Agency, Inc. from any claims, losses, or damages arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.
SECTION 12 – Governing Law
These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles.
